York Council Bully Boys Back in Action – 2nd Update

Being a professional journalist, Andy Peacher of Freedom Talk Radio has contacted a number of the people likely to be the subject of serious allegations in the radio broadcast on Saturday coming. He has been kind enough to ask them if they wish to participate or make a statement. This is what Andy wrote:

“I am currently working on a broadcast for Saturday coming (Saturday 27th September,  6pm UK time for 1 hour 30 minutes. Live show Link http://www.blogtalkradio.com/freedomtalkradiofreehosts/2014/09/27/the-knights-of-liberty-show-author-david-g-duchesneau–peter-hofschroer) which will cover a case of alleged corruption in York Social Services and North Yorkshire Police.

“You no doubt know of the case of Barbara Hofschröer and the allegations made by Lord Maginnis in Parliament that you are party to defrauding this 85 year-old invalid of her assets.

Her son Peter Hofschröer has given me to understand that you colluded in her recent abduction and are holding her to prevent her from litigating against you.

“As these are very serious allegations, I am sure you would welcome the opportunity of responding to them in a live radio broadcast.

“Please indicate that you are willing to do so to me at this e-mail address by 5 p.m. GMT on Thursday coming, 25th September 2014.

“Should we not hear from you by then, then we will assume that you are not disputing these very serious allegations and are exercising your right of silence so as not to incriminate yourself any further. We will then inform our listeners of this.

The answers started coming in almost immediately. For instance, on Monday‎, ‎22‎ ‎September‎ ‎2014 ‎at 21:48, Andy sent this e-mail to Cllr Tracey Simpson-Laing, one of Grandma B’s ward councillors. She must have been working late that night, as she replied less than an hour later. How often does one get a reply as quick as that from local government? She does seem to be a little nervous, does she not?

Dear Tracey, who is also Deputy Leader of the Council, Deputy Cabinet Leader, Cabinet Member for Homes & Safer Communities stated, “This case is in the hands of North Yorkshire Police and all such emails regarding this case are shared with them. I would refer you to the City of York’s Council Monitoring Officer, Andrew Docherty, who can give the an update and present position of the Council with regard to this matter”, which suggests she contacted Andrew Docherty before replying.

Dear Andrew’s health has been the subject of some speculation, as apparently he recntly had an “altercation” with James Alexander, leader of York Council. “Fat Jimmy”, as the Dear Leader is affectionately known in York, is said to be able to punch above his weight, which is a frightening thought (see: https://www.whatdotheyknow.com/request/alleged_assault_by_council_leade).

Dear Tracey, as we know, has played a very active role in the abuse of Grandma B. Indeed, when Grandma B went to a public meeting on her wheelchair to hand out a leaflet protesting at the way York SS and Jimmy Savile’s favourite police force were treating her, Dear Tracey set the police on her. Then at one stage Grandma B’s lawyers were forced to write to Dear Tracey to advise her to cease and desist from harassing Grandma B.

One wonders how much time North Yorkshire Police will have to deal with the correspondence York Council has so thoughtfully forwarded to them. Only two days ago, calls were made for the arrest of three chief officers for committing serious criminal offences in covering up the mass rape of children in their force area,

“I assert that all three Chief Officers [Chief Constable David Jones, DCC Tim Madgwick and ACC Sue Cross] are acting corruptly in joint enterprise to conceal misconduct in North Yorkshire Police over its acquiescence to a major paedophile vice ring that operated openly in Scarborough and Whitby with the full knowledge of North Yorkshire Police from the 1950’s onwards.  I would therefore ask that you record a complaint against all three officers for misconduct in public office and attempting to pervert the course of justice, and in the case of Deputy Chief Constable Madgwick additionally for harassment.”

These three chief officers are, of course, also actively involved in the abuse of Grandma B. Other York councillors picked up their e-mails during the course of the following morning, by which time Andrew Docherty appears to have issued guidelines on what to say. He seems to be a determined chap, squinting through his swollen, black eyes and typing away with his broken fingers in his determination to protect the reputation of the Dear Leader. Or maybe he feared another “altercation”.

Cllr. John Galvin was the first. He boasted, “Nor am I easily intimidated by spurious threats”. Threats? A polite request to participate in a radio show and answer serious allegations made against York Council? Dear John does seem to have got rather upset, doesn’t he? One wonders why. Well, if he has done nothing wrong, he has nothing to hide, right?

Now we are getting the first threats of “further action” even before the broadcast. That did not take long, did it?

It would seem that York Council has against forgotten what the law is on defamation since they last made such threats, only not to carry them out when the law was pointed out to them. As Andrew Docherty may well still be seeing stars, his error is forgivable. Well, just for Dear Andrew, here it is again:

Charles Arnold-Baker, in his seminal work “Local Council Administration” – universally recognised as the Councils’ “Bible” – has this to say on the subject of defamation:

 “Fair comment on a matter of public interest is not actionable. The acts and proceedings of a local council are matters of public interest, and a local council or other local authority as such cannot maintain an action for defamation if it is criticised [66] even if such criticism is intemperately expressed [67]. Criticism must, however, be fair and if it is so worded that it can reasonably be held to impute unworthy or corrupt motives to particular members they would, as individuals, be entitled to take action”.

“They would, as individuals, be entitled to take action” paid for by themselves and initiated through their own solicitor(s) under their own names, not anonymously through the Council’s solicitor, paid for by the public purse.

Would Dear Sandy be willing to put his money where his mouth is? Does anybody need three guesses here?

And as for making “assumptions” about his decision not to comment, this is the position in law:

“Qui tacet consentire videtur” runs the ancient maxim of common law – “Silence gives consent”; and from that maxim flows a widely applied legal principle: ‘the rule of tacit admission’. On the theory that an innocent man or woman would strenuously deny a serious charge, the rule holds that a suspect who remains silent in the face of an accusation has tacitly admitted the crime. Such silence can later be introduced at trial as an indicator of guilt.

What is clearly not right is to remain silent while continuing to act in public office – particularly as a ward councillor with access to vulnerable people, to whose abuse he does not deny being party.

So Dear Sandy, by chosing to exercise your right of silence here, you are making a tacit admission of guilt. That is inconsistent with being in public office.

When can we expect you to do the honourable thing and resign from the Council?

Is anybody holding their breath?

Both Dear Tracey and Dear Sandy led us to believe we would be hearing from Andrew Docherty, York Council’s Monitoring Officer, who would update us on their position in this affair. It would seem that Dear Andrew thought no answer would be the best answer. Either that, or he has not sufficiently recovered from his “altercation” with the Dear Leader to be able to say anything.

Either way, it seems that York Council is again exercising its right to silence here.

As expected, York Council’s “Monitoring Officer”, solicitor Andrew Docherty, who so much enjoys bullying defenceless old ladies, decided that no comment was the best comment on accusations of rampant corruption and criminal behaviour at senior levels in York Council. Or maybe he was not up do doing anything after the “altercation” with Fat Jimmy. Well, now he knows what it is like to be bullied. Despite public statements by several credible witnesses, York Council is denying the “altercation” ever took place. What else would one expect from a local authority in the once proud country of Britain?

We never heard any more from Dear Sandy, who threatened us with dire consequences if the radio show was broadcast. Presumably he read this blog and saw that he would have to put his money where his mouth is. And with a big mouth like his, that would have to be a lot of money.

Silence is golden, golden, but my eyes still see.
